GIFT HAMPER GIVEAWAY AND SPIN THE WHEEL
Official Contest Rules and Regulations
These Official Contest Rules and Regulations (the “Official Rules”) apply to gift hamper giveaways and Spin the Wheel promotions operated by The Caulking Store Inc. (the “Sponsor”). Each giveaway or promotion is referred to as a “Contest”.
By participating, entrants agree to these Official Rules and the applicable Contest Details described below. The Sponsor’s decisions concerning eligibility, participation and prize awards are final and binding, subject to applicable law.
1. APPLICABLE CONTEST DETAILS
Each Contest’s official signage, entry page, promotional materials or posted event instructions (the “Contest Details”) will identify the applicable entry period, closing time, participation location, prize descriptions, number of prizes, approximate retail values in Canadian dollars, and any additional participation requirements or limits. Where applicable, the Contest Details will also identify the draw timing, winner contact process and prize collection deadline.
These Official Rules contain no fixed event dates. The entry period and deadlines are those specified in the applicable Contest Details. Those details must be available before participants enter and form part of these Official Rules. Entries or spins outside the stated participation period will not qualify.
2. ELIGIBILITY
Contests are open to legal residents of Ontario, Canada, who are at least 18 years old at the time of entry.
Employees, representatives and contractors of the Sponsor, its affiliates, subsidiaries, advertising or promotional agencies, and their immediate family members or household members are not eligible. Immediate family means a spouse, parent, child or sibling.
The Sponsor may require proof of identity, age and eligibility before awarding a prize.
3. NO PURCHASE NECESSARY
No purchase is necessary to enter the gift hamper giveaway or receive the standard free Spin the Wheel opportunity. A purchase does not improve the odds of winning the gift hamper.
If bonus spins are offered, their qualifying conditions and limits must be clearly stated in the Contest Details before participation. Any purchase-linked bonus-spin offer must also provide a clearly disclosed, equivalent no-purchase method of obtaining the same bonus opportunity.
4. GIFT HAMPER GIVEAWAY: HOW TO ENTER
During the applicable entry period, scan the official QR code or visit the designated entry page and complete the entry form, including your name, email address, telephone number and any required survey questions. Submit the form and accept these Official Rules as instructed on the entry page.
Limit one entry per person per gift hamper giveaway. Using multiple email addresses, telephone numbers, identities or devices to obtain additional entries is prohibited. Duplicate, incomplete, late, automated or fraudulent entries will be disqualified.
Entering the gift hamper giveaway does not automatically entitle an entrant to a Spin the Wheel prize. Each activity has its own participation and winning requirements.
5. GIFT HAMPER PRIZE AND WINNER SELECTION
One gift hamper will be awarded to one confirmed winner per giveaway. Its contents and approximate retail value will be stated in the applicable Contest Details. Product images are illustrative unless identified as the actual prize.
After the entry period closes, the Sponsor or its designated representative will randomly select one potential winner from all eligible entries received, in accordance with the draw timing stated in the Contest Details. The odds of selection depend on the total number of eligible entries received.
The Sponsor will contact the selected entrant using the telephone number or email address supplied on the entry form. A public announcement is not required to notify or confirm a winner.
Unless a different response period is stated in the Contest Details, the selected entrant must respond within 72 hours of the Sponsor’s initial notification. Before being confirmed as the winner, the selected entrant must correctly answer an unaided, time-limited mathematical skill-testing question, meet all eligibility requirements and complete any reasonable prize acceptance documents requested by the Sponsor.
If a selected entrant cannot be contacted, does not respond within the applicable deadline, answers the skill-testing question incorrectly, declines the prize or fails to meet these Official Rules, that entrant forfeits the prize. The Sponsor may randomly select another potential winner from the remaining eligible entries using the same process until a winner is confirmed or no eligible entries remain.
6. GIFT HAMPER COLLECTION
The confirmed winner must collect the gift hamper from The Caulking Store at 5270 Solar Drive, Unit 22, Mississauga, Ontario L4W 0G7, unless another store pickup location is expressly identified in the Contest Details.
The gift hamper is pickup only. Shipping and delivery are not provided. The winner is responsible for travel and any expenses associated with collection.
The Sponsor will arrange collection with the confirmed winner. The collection deadline must be stated in the Contest Details and repeated in the winner notification. Proof of identity may be required at pickup. If the winner fails to collect the prize by that deadline, the prize may be forfeited and an alternate entrant selected in accordance with these Official Rules.
7. SPIN THE WHEEL: HOW TO PARTICIPATE
Eligible participants may visit the designated booth or promotional area during the participation period stated in the Contest Details and ask a Sponsor representative for a free spin.
Each person is entitled to one standard free spin per Contest. Any additional spins are available only under the qualifying conditions and limits expressly stated in the Contest Details, including any advertised bonus spin associated with a T-shirt promotion. Participation is subject to the posted operating hours and prize availability.
Participants must follow staff instructions and allow the wheel to come to a complete stop. The marked segment indicated by the pointer determines the potential prize or outcome. Participants may not interfere with the wheel, deliberately manipulate an outcome or spin again without authorization.
If a spin is invalid because of equipment malfunction or an unclear result, a Sponsor representative will permit a replacement spin. A valid result cannot be exchanged for a further spin.
8. SPIN THE WHEEL: PRIZES AND ODDS
The available prizes, quantities, approximate retail values and any non-winning outcomes will be disclosed in the Contest Details before a participant spins. Not every spin guarantees a prize unless the Contest Details expressly say otherwise.
The odds of a particular outcome depend on the wheel’s segment arrangement and operating mechanism. Relevant odds information and any prize availability restrictions must be disclosed before participation. A prize segment must not remain available as a winning outcome after its prize supply has been exhausted unless the disclosed rules provide an identified substitute of equal or greater value.
Before a prize is awarded, the participant must correctly answer an unaided, time-limited mathematical skill-testing question and satisfy the eligibility requirements. An incorrect answer or failure to meet these requirements results in forfeiture of that prize and does not entitle the participant to another spin.
Spin the Wheel prizes are ordinarily provided at the booth after verification. If later collection is required, the Sponsor will explain the arrangement and deadline before participation. T-shirt sizes and styles are subject to the availability disclosed at the booth. Limit one T-shirt prize per person per Contest, including any additional spins. Any alternative outcome for a participant who has already won a T-shirt must be disclosed before an additional spin.
Once the available prize stock has been exhausted, the winner must take any of the remaining items given by the Sponsor.
9. GENERAL PRIZE CONDITIONS
All prizes must be accepted as awarded. Prizes are non-transferable, non-refundable and cannot be exchanged for cash or credit. If a stated prize becomes unavailable, the Sponsor may substitute a prize of equal or greater value, subject to applicable law and the disclosed Contest Details.
Prizes will be awarded without unreasonable delay. Any costs or expenses not expressly included in a prize are the winner’s responsibility.
10. FAIR PARTICIPATION AND TECHNICAL ISSUES
All entries and participation are subject to verification. The Sponsor may disqualify a participant who provides false information, tampers with the entry or prize selection process, attempts to obtain unauthorized entries or spins, or otherwise breaches these Official Rules.
The Sponsor is not responsible for entries that are lost, late, incomplete, misdirected or not received because of technical failures. Proof of submitting an entry is not proof of receipt.
If fraud, equipment failure, technical issues or circumstances beyond the Sponsor’s reasonable control compromise a Contest, the Sponsor may suspend, modify or cancel it to the extent permitted by law. Any material change will be communicated through the applicable official Contest channels. The Sponsor will act fairly toward participants and preserve valid entries where reasonably possible.
11. PERSONAL INFORMATION AND MARKETING CONSENT
The Sponsor will collect and use entry information to administer the applicable Contest, verify eligibility, contact selected entrants and arrange prize collection.
Entering or participating does not automatically subscribe a person to marketing communications. Any consent to receive promotional emails or other marketing must be requested separately, be optional and have no effect on eligibility or the chances of winning. Participants may withdraw marketing consent using the unsubscribe instructions in those communications.
Personal information will not be sold or used for unrelated purposes without consent. It may be shared with service providers assisting with Contest administration, subject to appropriate safeguards, or where required by law. Information will be retained only as necessary for Contest administration and applicable recordkeeping requirements.
Permission to use a winner’s photograph, image or testimonial for promotional purposes will be requested separately and will not be a condition of receiving a prize. Contact the Sponsor using the details below with privacy questions or requests.
12. SOCIAL MEDIA PLATFORMS
Where a Contest is promoted through social media, it is not sponsored, endorsed or administered by, or associated with, Facebook, Instagram, TikTok, LinkedIn or any other social media platform. Entrants provide their information to the Sponsor, rather than those platforms. To the extent permitted by law, entrants release the applicable platforms from liability relating to the Contest.
13. LIABILITY AND GOVERNING LAW
To the extent permitted by applicable law, participants agree that the Sponsor and its representatives are not liable for losses or damage arising from participation or prize acceptance or use, except where liability cannot lawfully be excluded. Nothing in these Official Rules limits rights that cannot be waived under applicable law.
These Contests are subject to applicable federal, provincial and municipal laws and are void where prohibited. These Official Rules are governed by the laws of Ontario and the federal laws of Canada applicable therein. Disputes are subject to the jurisdiction of the courts of Ontario, subject to applicable law.
